Assumption of the Risk and Waiver of Liability Relating toCoronavirus/COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.

The Northland Swim Conference (“Conference”) and its members which include the Brooktree Swim Club, Clayview Country Club, Coves Swim Team, Hill of Walden Swim Team, Kearney Swim Team, New Mark Swim Team, Old Pike Country Club, Riss Lake Swim Team, Thousand Oaks Swim Club, Walnut Creek Swim Team, and Woodneath Farms Swim Team (“Member Clubs”) have attempted to put in place preventative measures to reduce the spread of COVID-19; however, the Conference and its Member Clubs cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending or participating in the activities of the Conference and Member Clubs could increase your risk and your child(ren)’s risk of contracting COVID-19.

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending or participating in Conference and Member Club activities and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 may result from the actions, omissions, and negligence of myself and others, including, but not limited to, the Conference or Member Club representatives, employees, agents, volunteers, sponsoring organizations, home owners associations, and program participants and their families.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with me or my child(ren)’s attendance or participation at Conference or Member Club events and activities. On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless the Conference and Member Clubs, their representatives, employees, agents, volunteers, sponsoring organizations, and home owners associations, of and from all claims, actions, damages, costs or expenses of any kind, arising out of their negligence conduct (“Claims”).I understand and agree that this release includes Claims based on the actions, omissions, and negligence of the Conference and Member Clubs, their representatives, employees, agents, volunteers, sponsoring organizations, and home owners associations, whether a COVID-19 infection occurs before, during, or after participation in any Conference or Member Club event or activity.

I certify that I am the parent or legal guardian for my child(ren). I hereby give my permission for any supervisor, coach or other team administrator associated with the The Coves Swim Team to seek and give appropriate medical attention for our child(ren) in the event of accident, injury, illness. I will be responsible for any and all costs associated with any necessary medical attention and/or treatment.

I hereby waive, release and forever discharge The Coves Swim Team and associated supervisor, coach or other team administrator from all rights and claims for damages, injury, loss to person or property which may be sustained or occur during participation in The Coves Swim Team activities, whether or not damages or loss is due to negligence. I hereby acknowledge that my children is (are) physically fit and capable of participation in all Swim Team activities.

CONCERNS:

One of the traditional swim team communication gaps is that some parents feel more comfortable in discussing their disagreements or issues concerning coaching ability, philosophy, or team policies with other parents rather than taking them directly to the coach or the board. This approach often results in new problems being created, and rarely resolves the initial problem. This approach will not be tolerated. Parents shall refrain from gossip with other parents and all swimmers, including their own.

Parent/Guardian Code of Conduct: 

In order to show positive support and actions towards The Coves Swim Team, its parents, swimmers, coaches, officials and other members in daily activities.

I pledge:

• To discuss with and assist my child in understanding the Swimmer Code of Conduct.
• To nurture my child in swimming. I will instill an understanding of and appreciation for self-esteem, personal accountability, self-discipline, goal setting and goal achievement.
• To ensure my child is on time to all practices and meets.
• To pick my child up from practice on time.
• To read team communication.
• To volunteer for home and away swim meets. (At least 1 half per meet/per family)
• To advise the coaches of any medical problem my child may have.
• To stay off of the pool deck during practice. If I must remove my child from practice early, I will do so only during a time that is least intrusive. If I must speak to the coach, I will do so only after the conclusion of the scheduled practice times. I will not interfere with the coaches on the pool deck.
• To demonstrate good sportsmanship by conducting myself in a manner that earns the respect of my child, other swimmers, parents, officials, and the coaches at the meets and practices. I understand that criticizing, name-calling, use of abusive language or gestures towards the coaches, officials, volunteers, and/or any participating swimmer will not be permitted.
• To never challenge an Officials decision at a meet. If I have a question or concern, I will ask the coach to raise the issue with the Official.
• Not to coach or instruct the team or any swimmer at practice or meets (from the stands or any other area) or interfere with the coaches on the pool deck while performing their job. I will maintain self control at all times.
• To notify the coach via email of any anticipated absences from regular practices or meets.
• To supervise my child during meets.
• The use of alcoholic beverages during practice or meets is prohibited.
• Refrain from the use of performance enhancing drugs or stimulants by an athlete.
• Refrain from the use of drugs other than those prescribed by a physician.
• Refrain from the use of tobacco or vaping on the pool deck or surrounding areas.

Possession of any item that can be considered a weapon at any team function is prohibited.

The following will not be tolerated: Any non-consensual physical contact, obscene language or gesture, or other threatening language or conduct directed towards another Coves Swim Team parent or member, meet official or USA Swimming Coach will not be tolerated!

If you disagree with a coach, a board member, or an official, please speak with them in a private setting. If you disagree with another parent, please speak to a board member.

Any other act, conduct or omission not provided above, which is detrimental to the image or reputation of The Coves Swim Team, USA Swimming, a LCS or the sport of swimming will not be tolerated.

Code of Conduct Violations Will Be Processed as Follows:

1. First Offense: A written letter from the board to the swimmer and/or parent explaining the Code of Conduct Violation which could lead to one or more of the following:

a: A written warning with the understanding that if any further offense is violated, automatic suspension or expulsion from the team will result.

b: Suspension from ALL team activities for a set amount of time.

c: Expulsion from the team (Drug usage, weapons, etc)

2. Second Offense: Suspension or Expulsion from the team.

Swimmer Code of Conduct

I Pledge:

• To treat all members of the team including coaches, swimmers, parents and our opponents with consideration and fairness.
• To be respectful of team property.
• To practice good sportsmanship.
• To refrain from judging others, using inappropriate language or profanity in a verbal or electronic forum.
• To demonstrate a positive attitude towards learning.
• To be on time to practice with all necessary equipment.
• To follow the coaches directions at all times.
• To not leave the pool deck until all trash and personal equipment is picked up.
• To refuse tobacco, alcohol, and drugs.
• To refuse to participate in theft or vandalism of any kind.
• To practice hard, have fun and do my very best.
• To comply with the rules and regulations of USA Swimming and the Northland Conference. I understand that if I fail to follow this code of conduct, I could be removed from the team.

I acknowledge that I have received, read and understood the Minor Athlete Abuse Prevention Policy and/or that the Policy has been explained to me by my family. I further acknowledge and understand that agreeing to comply with the contents of this Policy is a condition of my membership with The Coves Swim Team (USA Swimming member club).
